22-8-13 Entry into force of Biocidal Products Regulation imminent

1 September 2013 sees the entry into force of the new Biocidal Products Regulation (BPR), which is replacing the existing Biocidal Products Directive (BPD). For FINAT members, it is important to note that the BPR contains provisions which apply not only to biocidal products but also to all articles, which have been treated or incorporate a biocidal product.

In particular, articles can only be treated with active substances which have been approved in the EU for that purpose. This is a significant change to the previous requirements under the Biocidal Products Directive (BPD), where articles imported from outside the EU could be treated with substances not allowed in the EU.

Article 3 of the BPR defines a treated article as “any substance, mixture or article which has been treated with, or intentionally incorporates, one or more biocidal products”

FINAT as member of the CheMI platform is in discussion with authorities for further clarification on the status of treated articles and the guidance on treated articles which is currently being drafted by the Commission.

29-05-13 Food contact guidance for adhesives

FEICA, the industry association of the European sealant and adhesives industry, published a guidance document on the food contact status declaration for adhesives. It summarizes the relevance of Regulation EC 1935/2004, 2023/2006 and 10/2011 for adhesives and gives insight into European national legislation.
